1. Purpose of This Policy
This Copyright and Intellectual Property Policy explains how BookCollar handles intellectual property rights, user content, copyright complaints, takedown requests, counter-notices, repeat infringers, trademark issues, and related claims.
This policy applies to:
- Customers
- Providers
- Provider applicants
- Visitors
- Account holders
- Rights holders
- Anyone who submits, posts, uploads, displays, sends, or claims rights in content on or through the BookCollar platform
This policy is incorporated into the BookCollar Terms of Service and Provider Terms.
2. Platform Intellectual Property
BookCollar and its licensors own or license the BookCollar platform, including:
- Software
- Source code
- Object code
- Website design
- App design
- User interfaces
- Layouts
- Graphics
- Text
- Icons
- Logos
- Branding
- Trade names
- Trademarks
- Service marks
- Platform workflows
- Platform features
- Databases
- Documentation
- Other protected materials
Except as expressly allowed by BookCollar in writing or permitted by applicable law, users may not:
- Copy BookCollar materials
- Modify BookCollar materials
- Distribute BookCollar materials
- Sell BookCollar materials
- Lease BookCollar materials
- Publicly display BookCollar materials
- Publish BookCollar materials
- Reverse engineer protected technology
- Create derivative works from BookCollar materials
- Use BookCollar branding in a misleading way
- Remove copyright, trademark, or proprietary notices
- Use BookCollar materials for a competing service
- Scrape, harvest, or reproduce platform content in violation of BookCollar policies
3. Limited Permission to Use the Platform
Subject to the Terms of Service and applicable policies, BookCollar grants users a limited, revocable, non-exclusive, non-transferable permission to access and use the platform for its intended marketplace purposes.
This permission does not transfer ownership of BookCollar intellectual property to any user.
BookCollar may suspend or terminate access if a user violates this policy, the Terms of Service, Provider Terms, or other platform policies.
4. User and Provider Content
Users may submit, post, upload, display, send, or provide content through the platform.
User content may include:
- Provider profile information
- Business names
- Business descriptions
- Listing descriptions
- Service photos
- Portfolio photos
- Logos
- Videos
- Messages
- Customer reviews
- Ratings
- Comments
- Support submissions
- Dispute evidence
- Safety reports
- Other uploaded or submitted materials
Users retain ownership of content they submit, subject to the rights and licenses granted to BookCollar in this policy, the Terms of Service, Provider Terms, and other applicable agreements.
5. License to BookCollar
By submitting, posting, uploading, displaying, sending, or otherwise providing content to or through the platform, you grant BookCollar a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, display, publish, distribute, adapt for technical purposes, create derivative works for platform operation, use, and otherwise process your content as reasonably necessary to:
- Operate the platform
- Display profiles and listings
- Facilitate bookings
- Provide customer support
- Investigate disputes
- Investigate safety reports
- Enforce policies
- Improve the platform
- Promote BookCollar
- Promote provider listings or services, where permitted
- Display reviews and ratings
- Maintain business records
- Comply with legal obligations
- Protect users, providers, BookCollar, and others
This license continues for as long as necessary for the purposes described above, subject to applicable law and BookCollar's data retention practices.
6. Marketing Use of Provider Content
BookCollar may want to use provider profile content, listing content, photos, videos, business names, reviews, or other submitted materials to promote the platform or provider listings.
Examples may include:
- Website pages
- Search results
- Listing pages
- Social media posts
- Email marketing
- Paid advertisements
- App store previews
- Platform screenshots
- Promotional materials
BookCollar will use submitted content according to the Terms of Service, Provider Terms, this policy, and applicable law.
7. User Representations About Content
By submitting content to BookCollar, you represent and warrant that:
- You own the content or have permission to use it
- You have the right to submit the content to BookCollar
- You have the right to grant BookCollar the license described in this policy
- The content does not violate copyright law
- The content does not violate trademark law
- The content does not violate privacy rights
- The content does not violate publicity rights
- The content does not violate contract rights
- The content does not contain confidential information you are not allowed to share
- The content does not mislead users
- The content does not violate BookCollar policies
- The content does not violate applicable law
Users are responsible for content they submit.
8. Prohibited Intellectual Property Conduct
Users may not:
- Upload content they do not own or have permission to use
- Use stolen photos
- Copy another provider's listing content
- Use another business's logo without permission
- Use copyrighted images without permission
- Use copyrighted music, videos, or media without permission
- Misuse trademarks
- Use another person's name, likeness, photo, or identity without permission
- Misrepresent affiliation with a brand, company, provider, or BookCollar
- Post counterfeit, fake, misleading, or infringing content
- Remove or alter copyright notices
- Use BookCollar content outside the platform without permission
- Use content from the platform to build a competing service
- Submit false IP complaints
- Submit abusive takedown requests
9. Copyright Notice and Takedown Process
If you believe content on BookCollar infringes your copyright, you may submit a written copyright notice to BookCollar.
A copyright notice should include:
1. Identification of the copyrighted work you claim has been infringed.
2. Identification of the material you claim is infringing and information reasonably sufficient for BookCollar to locate it.
3. Your name, mailing address, phone number, and email address.
4. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in the notice is accurate.
6. A statement, made under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
7. Your physical or electronic signature.

10. Incomplete or Invalid Copyright Notices
BookCollar may be unable to act on copyright notices that are incomplete, inaccurate, unclear, or do not provide enough information to identify the allegedly infringing material.
BookCollar may request additional information before taking action.
11. Action After Receiving a Copyright Notice
After receiving a copyright notice, BookCollar may:
- Review the complaint
- Request more information
- Remove or disable access to the content
- Notify the user who submitted the content
- Preserve relevant records
- Reject incomplete or unsupported notices
- Take action against repeat infringers
- Take other action required or permitted by law
BookCollar may remove or disable content while claims are reviewed.
12. Counter-Notice Process
If your content was removed or disabled because of a copyright complaint and you believe the removal was a mistake or misidentification, you may submit a counter-notice.
A counter-notice should include:
1. Identification of the material that was removed or disabled.
2. The location where the material appeared before it was removed or disabled.
3. Your name, mailing address, phone number, and email address.
4. A statement, made under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
5. A statement that you consent to the jurisdiction of the appropriate federal court.
6. A statement that you will accept service of process from the person who submitted the original copyright notice or that person's agent.
7. Your physical or electronic signature.

13. Repeat Infringer Policy
BookCollar may suspend or terminate accounts of users who repeatedly infringe copyright or other intellectual property rights.
In evaluating repeat infringement, BookCollar may consider:
- Number of valid complaints
- Severity of complaints
- Whether complaints involve the same or different works
- Whether the user responded to notices
- Whether the user submitted valid counter-notices
- Whether the user knowingly submitted infringing content
- Whether the user repeatedly uploads removed content
- Evidence of bad faith
- Applicable law
- Platform safety and integrity concerns
BookCollar may also restrict listings, remove content, limit account features, or take other action against users who violate this policy.
14. False or Abusive IP Claims
Submitting false, misleading, or abusive copyright or intellectual property claims may result in legal liability and BookCollar enforcement action.
Users and rights holders should not submit IP complaints unless they have a good-faith belief that the content violates their rights.
BookCollar may restrict or reject abusive, repeated, unsupported, or bad-faith complaints.
15. Trademark and Brand Use
BookCollar names, logos, trademarks, service marks, trade names, slogans, and branding are owned by BookCollar or its licensors.
Users may not use BookCollar marks in a way that:
- Suggests sponsorship
- Suggests endorsement
- Suggests affiliation
- Suggests partnership
- Misleads users
- Confuses users
- Damages BookCollar's reputation
- Violates BookCollar policies
Providers may not use third-party trademarks, logos, business names, or brand identifiers in listings, profiles, keywords, metadata, or promotional content in a misleading, infringing, or unauthorized way.
BookCollar may remove or restrict content that appears to misuse trademarks or create confusion.
16. Other Intellectual Property and Rights Claims
BookCollar may review claims involving:
- Trademarks
- Copyrights
- Publicity rights
- Privacy rights
- Trade names
- Business names
- Logos
- Photos
- Portfolio materials
- Confidential information
- Other intellectual property or proprietary rights
BookCollar may request additional documentation, remove content, restrict content, contact the user who submitted the content, or take other action based on available evidence, platform policies, and applicable law.
17. Provider Photos, Portfolio Images, and Listing Materials
Providers are responsible for making sure all photos, videos, portfolio materials, descriptions, logos, business names, and listing materials they submit are lawful and authorized.
Providers should only upload materials that:
- They created
- They own
- They have permission to use
- They are legally allowed to display
- Do not violate another person's privacy or publicity rights
- Do not mislead customers
- Accurately represent their services
Providers may not upload stock photos, client photos, before-and-after photos, or portfolio materials unless they have all required rights and permissions.
18. Customer Reviews and User Submissions
Customers are responsible for ensuring that reviews, ratings, photos, comments, and other submissions they provide do not violate copyright, privacy, publicity, defamation, or other legal rights.
Customers should not upload another person's private information, images, or content without permission.
BookCollar may remove or restrict reviews or submissions that violate this policy, the Community Standards, or applicable law.
19. BookCollar's Right to Remove Content
BookCollar may remove, restrict, hide, disable, or refuse to display content that BookCollar believes:
- Violates this policy
- Violates the Terms of Service
- Violates Provider Terms
- Violates Community Standards
- Violates the Prohibited Services Policy
- Violates law
- Infringes intellectual property rights
- Violates privacy or publicity rights
- Is misleading
- Creates legal risk
- Creates safety risk
- Creates platform integrity risk
- Is otherwise inappropriate for the platform
BookCollar is not required to monitor all content before it is posted.
20. No Legal Determination
BookCollar may remove, restrict, or restore content based on platform policies and available information.
BookCollar's decision to remove, restrict, restore, or allow content is not a legal determination that the content does or does not infringe rights.
Users and rights holders are responsible for resolving legal disputes where necessary.
21. Relationship to Other Policies
This policy should be read together with:

- Booking, Cancellation, Refund, and Reschedule Policy
- Any terms shown during signup, provider onboarding, listing creation, booking, payment, messaging, review, or content submission workflows
If there is a conflict between this policy and another BookCollar policy, the more specific policy will generally control for the specific issue it addresses, unless otherwise stated.
22. Policy Updates
BookCollar may update this policy from time to time to reflect legal requirements, platform changes, operational needs, safety concerns, or business practices.
Updated versions will be posted with a revised effective date or last updated date.
Where required by law or appropriate based on the change, BookCollar may provide additional notice or require users to accept updated terms.
