Terms of Service

Core agreement covering platform use, account rules, bookings, and key legal limitations.

1. Scope and acceptance

These Terms of Service govern use of the BookCollar website, applications, and marketplace tools (collectively, the "Platform"). By creating an account, posting a listing, booking a service, or otherwise using the Platform, you agree to these terms and all policies referenced in them.

If you do not agree, do not use the Platform.

2. Marketplace role

BookCollar is a marketplace that helps customers and independent service providers connect. Unless explicitly stated in writing, BookCollar is not the provider performing the service.

Providers are solely responsible for the services they advertise and deliver, including quality, timeliness, legal compliance, permits, and required insurance.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your location) and legally able to enter contracts. You agree to provide accurate account details and keep them up to date.

You are responsible for activity under your account and for safeguarding login credentials.

4. Listings, bookings, and communication

Providers must publish truthful listings, including service details, pricing, and availability. Misleading, fraudulent, or prohibited listings may be removed.

Customers are responsible for reviewing listing details before submitting booking requests. Platform messages should be used for booking communication so both parties have clear records.

5. Fees and payments

BookCollar may charge platform, service, or processing fees as described at checkout or in provider tools. Fees may vary by transaction type.

Taxes, including sales or income taxes, remain each party's responsibility unless BookCollar explicitly states otherwise.

6. Cancellations, refunds, and disputes

Cancellations and refund handling are governed by BookCollar's Booking and Cancellation Policy and any listing-level cancellation setting where allowed.

When disputes occur, users agree to cooperate in good faith and provide supporting records requested by BookCollar.

7. Acceptable use

You may not use the Platform for unlawful activity, harassment, discrimination, fraud, malware distribution, scraping in violation of these terms, or attempts to bypass platform safety controls.

BookCollar may investigate and remove content, restrict features, suspend accounts, or terminate access for policy violations.

8. User content and license

You retain ownership of content you post (such as listing photos, profile details, and reviews), but you grant BookCollar a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content to operate and promote the Platform.

You represent that you have rights to any content you upload and that the content does not infringe third-party rights.

9. Disclaimers and limitation of liability

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BookCollar disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, BookCollar's total liability for claims arising from these terms or the Platform will not exceed the greater of (a) amounts you paid to BookCollar in the previous 12 months, or (b) $100 USD.

10. Indemnification

You agree to defend, indemnify, and hold harmless BookCollar and its affiliates from claims, liabilities, damages, and costs arising out of your content, your use of the Platform, or your violation of these terms or applicable law.

11. Changes, governing law, and contact

BookCollar may update these terms and policies. Material updates become effective when posted unless a different effective date is stated.
